See If You Qualify

Most individuals are eligible to file for bankruptcy under Chapter 7 or Chapter 13. If your total annual household income (including your spouse’s income, unless you’re separated) is at or below the median family income for your state and household size, you can choose to file under either Chapter 7 or Chapter 13. If your household income exceeds the state median for your family size, you may still qualify for Chapter 7 but will need to pass a “means test” to confirm eligibility. Nearly everyone qualifies for Chapter 13, regardless of income level.
